Who you deal with
FleetOps is made and licensed by Pravin Banjade, based in Nepal ("we", "us"). These terms apply between us and the person or organisation buying or using a paid plan ("you").
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle's own buyer terms also apply to your purchase.
Editions
Community is free software under the Apache License 2.0. These terms do not restrict your rights under that license.
Enterprise features are unlocked by a license file you receive when you buy Starter, Scale or Enterprise. Their source code is available in the same repository under its own license, described on the open source page.
Orders and payment
- Prices are shown in US dollars on the pricing page, before any tax Paddle adds for your country.
- Paid plans are sold per node, in blocks of five. A node is a Docker or Podman host the server manages, or a node of a connected Kubernetes cluster.
- You pay monthly or yearly, in advance, through Paddle's checkout. Paddle issues the invoice or receipt.
- Enterprise plans are quoted individually and may be invoiced directly under a separate agreement.
Your license
For as long as your plan is paid, we grant you a non-exclusive, non-transferable right to use the Enterprise features on up to the number of nodes you bought, within your organisation.
- The license is a signed file checked offline. FleetOps does not contact us to check it.
- If you go over your node count, tell us and buy another block, or reduce your nodes at renewal.
- You may not resell, share or publish the license file, or remove the license check.
- When the license expires, Enterprise features keep working for 14 days, then switch off. Community features and your data are not affected.
Renewal and cancellation
Plans renew automatically at the end of each billing period until you cancel. You can cancel at any time from the link in your Paddle receipt or by writing to us; the plan then runs to the end of the period you have paid for. Refunds are covered by the refund policy.
Support
Support is provided as described for your plan on the pricing page. Response times are targets, not guarantees, unless an Enterprise agreement says otherwise.
Acceptable use
You run FleetOps on your own infrastructure and are responsible for how it is configured and who has access to it, including access to the Docker socket, which is equivalent to root on the host.
Warranty and liability
FleetOps is provided "as is". To the extent the law allows, we give no warranty that it will be free of errors or fit for a particular purpose, and we are not liable for indirect or consequential loss, lost data or lost profit. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim. Nothing here limits liability that cannot be limited by law.
Changes
We may update these terms. Changes apply from your next billing period, and we will note the date at the top of this page. Price changes never apply to a period you have already paid for.
Governing law
These terms are governed by the laws of Nepal, without affecting any consumer rights you have under the law of the country where you live.
